Terms of Service

These Terms of Service ("Terms") govern your access to and use of the services, website, and tools provided by Hungry Touch ("we," "our," or "us"). By signing up for, accessing, or using our services, you agree to be bound by these Terms.

1. Services

Hungry Touch provides digital marketing services for restaurants and food-service businesses, including but not limited to:

  • Social media content creation and management (Instagram, Facebook, TikTok, YouTube)

  • Video production, editing, and publishing

  • Website design and management

  • Online menu optimization

  • Google Business Profile management

  • Customer portal access for content review and approval

  • AI-powered customer service tools

  • Contest and promotion management

Service deliverables are outlined in individual proposals or subscription plans agreed upon between you and Hungry Touch.

2. Account & Authorization

To use our services, you may be required to:

  • Provide accurate business and contact information

  • Authorize Hungry Touch to access and manage your social media accounts through platform-specific authorization mechanisms (such as OAuth)

  • Grant necessary permissions for content publishing on your behalf

You are responsible for maintaining the confidentiality of your account credentials. You agree to notify us immediately of any unauthorized use of your accounts.

3. Social Media Account Access

When you authorize us to manage your social media presence, you grant Hungry Touch permission to:

  • Upload and publish content (videos, images, text) to your connected social media channels

  • Manage content scheduling and publishing on your behalf

  • Access basic channel information necessary for content publishing

You may revoke this access at any time by contacting us at hello@hungrytouch.com or by removing our access through the respective platform's security settings.

4. YouTube API Services

Our services may include uploading video content to YouTube on your behalf using the YouTube Data API. By authorizing this functionality:

5. Content Ownership

All marketing content created by Hungry Touch on your behalf (including videos, images, graphics, and copy) is created as work-for-hire for your business. You retain ownership of your brand, business name, and proprietary information you provide to us.

Hungry Touch retains the right to use samples of completed work in our portfolio and marketing materials, unless you request otherwise in writing.

6. Client Responsibilities

You agree to:

  • Provide accurate and current information about your business

  • Respond to content approval requests in a timely manner

  • Ensure that content you provide to us does not infringe on third-party rights

  • Not share confidential tools, templates, or proprietary resources provided by Hungry Touch with third parties

  • Comply with all applicable laws and platform policies related to your social media presence

7. Payment & Billing

  • Subscriptions are billed automatically on a monthly or annual basis, depending on your selected plan

  • Payment is processed securely through Stripe or another approved payment gateway

  • Failure to pay may result in service suspension or termination

  • Refunds are handled on a case-by-case basis as outlined in your service agreement

8. Termination

Either party may terminate the service relationship with written notice as specified in the service agreement. Upon termination:

  • We will cease publishing content on your behalf

  • We will revoke access to any shared tools or portals

  • We will delete your stored API tokens and credentials within 30 days

  • Any outstanding balances remain due and payable

9. Limitation of Liability

Hungry Touch shall not be liable for any indirect, incidental, special, or consequential damages arising from the use of our services, including but not limited to loss of revenue, social media account issues, or platform policy changes beyond our control.

Our total liability for any claim arising from our services shall not exceed the amount paid by you to Hungry Touch in the three (3) months preceding the claim.

10. Modifications

We reserve the right to modify these Terms at any time. Material changes will be communicated via email or through our Customer Portal. Your continued use of our services after such modifications constitutes acceptance of the updated Terms.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of New York, without regard to conflict of law principles.
